Debt advice is something most of us seek at one point or another in our lives. Today's economy brings its own share of problems, resulting in a redefinition of what it means to be an honest, contrite debtor. Through a series of circumstances, people may find themselves in debt without really intending to get there, and the debt may be spiraling out of control.
People may not think too much about it at first, believing their
cirumstances to be mostly temporary, but the truth may be around the next
corner as they run out of money and max out their credit.
A contrite honest debtor is the person who needs some debt relief to gain
a fresh start and also wants to repay creditors in an orderly way to the
extent that property or money is available to do so. Most people want to
honor their obligations in life, and will go to great lengths to do so as
long as there is hope for their future.
Usually, in most countries, bankruptcy is a process that is regulated by
law. In the UK, the Enterprise Act of 2002 and consequent reforms in 2004
refined Britain's approaches to bankruptcy proceedings, in particular
shortening the bankruptcy durations. The Enterprise Act specifically
states the following: "to amend the law relating to the protection of the
collective interests of consumers; to make further provision about the
disclosure of information obtained under competition and consumer
legislation; to amend the Insolvency Act 1986 and make other provision
about insolvency" among other important issues. Scotland's revised
bankruptcy regulations came in force in April, 2008 through Scottish
Regulatory Instrument 2008 No. 82. The federal law dealing with bankruptcy
in Canada is the Bankruptcy and Insolvency Act. All these can be found
using an internet search.
At the end of the bankruptcy process, eligible debts are cancelled, or
discharged, meaning the debtor no longer has any liability to pay them.
For many, bankruptcy is an intelligent, realistic choice. Once it is
filed, creditors cannot pursue further action such as judgements against
the debtor, and many debts can be written off. However, bankruptcy has its
own share of complications, and because of that, people may turn to debt
management and debt management organizations to help them out.
